MALAWI: GIRAMATA IN COURT POLICE ARRIVED AT ALLEGED CAUSE OF AN ACCIDENT PROVIDED CONFIDENCE
The prosecution case against Giramata Gentile and Munyamagaju Rafiki was resumed today, Wednesday, October 2, 2024 before Judge Bruno Kalemba at the Lilongwe High Court. The director of Kamuzu hospital confirmed that the body of the late Emile was examined by Mwale, that the examination done by Banda who was requested by GIRAMATA is invalid because he did this examination when he was transferred to Muzuzu hospital. The policeman who went to the scene of the attack said that the car was driven by Munyamagaju Rafiki and he did not have a driver’s license. He said that the car hit a fire pole while Emile was sleeping on the mattress behind the driver, so Emile may have died because of this accident. Police said the car had damage on the front side of the car, not the driver’s side. Police Sergeant KAMBEWA said he was informed of the accident at 5:15 in the morning. He said he went to Kamuzu Hospital and found Emile’s body with a head injury. This point of injury is contradicted by the testimony of the hospital staff who examined the body of the deceased and the testimony of Emile’s mother who confirmed that Emile had no injuries at all. This police officer said he was the one who asked Banda to examine the body of the deceased. At this point, one may wonder why he went to ask an employee who was not yet registered at Kamuzu Hospital to examine the body.. the prosecution asked Sergeant Kambewa if he saw the body of the late HABIMANA EMILE and he replied that he did. he said without remembering. The judge thanked him for attending the invitation of the court. The prosecutor then informed the court that another witness had an illness and asked the court that the case be moved to another day. There was a search for dates that all the parties would be ready and they agreed that the case will be resumed on the 17th of October 2024 at three o’clock in the morning. ordered that GIRAMATA and RAFIKI remain in custody.
In an interview with the media, when the prosecutor was asked how the case is progressing, he said: on our side, the case is going well, all the evidence we are presenting today, we brought the head of the autopsy and he explained clearly how the autopsy was done, that the official report was made by Mr. MWALE because he was the one who was at work at the time BANDA made a report that EMILE is not at work.
on the side of GIRAMATA’s lawyer, he also said that they see that things are going well, that his lawyer has no evidence of his death. He told the media that he reconciled the medical report made by Mr. BANDA with the testimony of the policeman who made the report, which shows that the deceased was killed by an accident.
when asked by step newspaper about another testimony given by the hospital staff who examined the body, which showed that EMILE did not have an accident, GIRAMATA’s lawyer told step newspaper that the court will examine all sides and give a decision.
